Terms of Service

How Viever works, and what you agree to when you use it.

These Terms of Service ("Terms") govern your use of the Viever mobile application and any related services provided ("we," "us," or "our"). By downloading, accessing, or using Viever, you agree to these Terms. If you do not agree, do not use the app.

1. Purpose of the App

Viever is a wellness, support, and care-coordination application designed to help users manage items such as: mood check-ins, appointments, brain games, linked care/carer support features, notifications, exports, and optional calendar syncing.

Viever is intended as a supportive informational tool only and is not a medical device, emergency monitoring service, or substitute for professional medical, mental health, or legal advice.

2. Eligibility and Account Use

To use certain features, you may need to create an account. You agree to:

3. Health and Wellness Disclaimer

Viever may help you track mood, appointments, or wellness-related information, but:

You remain solely responsible for your healthcare decisions, medication schedules, and emergency actions. If you are experiencing a medical emergency, call emergency services immediately.

Viever is not intended for crisis support, suicide prevention, emergency response, or real-time health monitoring. The app is not monitored 24/7, and we do not guarantee that carers, linked users, or notifications will respond in a timely manner. If you are in immediate danger or distress, contact local emergency services or a crisis support service immediately.

4. Carer and Linked-User Features

Viever may allow a user to link with a carer or support person, typically a loved one or family member. By using those features, you understand that:

5. Notifications and Calendar Sync

Viever may offer push notifications and optional calendar export or sync to services such as Google Calendar or other phone calendar apps. These features are provided for convenience only. We do not guarantee that reminders, alerts, or calendar events will always be delivered correctly or on time.

We may suspend or terminate access immediately, with or without notice, where we reasonably believe there is misuse, risk to users, legal non-compliance, or harm to the service.

6. Subscription Plans and Paid Features

Some features may be limited to certain plan tiers, including free and paid plans. If you purchase a subscription:

8. Your Data and Privacy

Your use of Viever is also governed by our Privacy Policy, which explains how your data is collected, used, stored, and deleted. By using the app, you acknowledge that data may be stored locally on your device and/or processed through secure cloud services that support app functionality. 9. Data Deletion and Account Termination

You may stop using the app at any time. You may also request deletion of your account and associated data through the app's account deletion functionality or by contacting info@viever.com.au.

When your account is deleted: access to the app account may be removed, local device data may be cleared, and associated cloud-stored data may be deleted or de-identified, subject to technical limitations, backup retention, fraud prevention, legal obligations, or legitimate security needs. If you exported data to third-party services such as a calendar provider, you may need to remove that data separately.

We may also suspend or terminate your access if required for security, legal, or misuse-related reasons.

10. Intellectual Property

Viever, including its design, code, branding, graphics, content structure, and related materials, is owned by the developer or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use in accordance with these Terms.

11. Third-Party Services

Viever may rely on third-party platforms or services, including cloud hosting, authentication, notifications, subscriptions, mapping/location, sharing, or calendar integrations. We are not responsible for outages, data handling, or policies of third-party services. Your use of those services may also be subject to their own terms and privacy policies.

12. No Warranty

Viever is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free availability. We do not guarantee that the app will always be secure, accurate, available, or free from bugs.

13. Limitation of Liability

To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, health-related outcomes, missed reminders, service interruptions, or lost profits arising from your use of the app. If liability cannot be excluded, it will be limited to the minimum amount allowed by law.

We will not be liable for delays or failures caused by events beyond our reasonable control, including network failures, service outages, natural disasters, or actions of third-party providers. We do not control, monitor, or supervise linked carers or users, and we are not responsible for their actions, omissions, or advice.

14. Indemnity

You agree to indemnify and hold harmless the developer from claims, losses, liabilities, and expenses arising from: your misuse of the app, your violation of these Terms, your violation of another person's rights, or information you share through the linked care features.

15. Changes to the App or Terms

We may update or modify the app, add, remove, or change features, and update these Terms from time to time. If we make material changes, we may provide notice within the app or by other appropriate means. Continued use of the app after updates means you accept the revised Terms. If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia, without regard to conflict of law principles. Any disputes relating to these Terms or the app will be handled in the courts or forums permitted under the laws of the Commonwealth of Australia, unless applicable consumer law provides otherwise.

In these Terms of Service, a reference to Viever is a reference to Viever Solutions (ABN: 25 229 143 456).
